Case History: Discrimination Lawsuit
EVERSON, ET AL V. THE COCA-COLA COMPANY, CASE NO.: 1-01-CV-2525-RWS
FULTON COUNTY DISTRICT COURT DOCUMENTS SHOW:
I filed my original discrimination lawsuit against Coca-Cola because I trained numerous Caucasian secretaries. Many of the Caucasian secretaries were promoted to higher positions, but it took me eleven years to receive one promotion. Even though I received good job performance rating annually. I was in a lower pay grade, and being paid less than the Caucasian secretaries, and when I complained to management they moved me into a position (Finance Reimbursement Specialist) that was not even recognized by the company as a legitimate position. I didn’t get any promotion, and the position they moved me out of was made into two positions (one of them was higher pay than mine).
I was in the (Finance Reimbursement Specialist) position for three years. The vice president, human resource managers, and department managers signed my annual performance review listing the “made-up title”. I later obtained my employment records which confirmed I had never been a (Finance Reimbursement Specialist). I had been bamboozled.
It really hurt me to know all those people were involved in a deceitful act against me just to evade giving me equal pay. This is the only reason a vice president or any other manager would sign a annual performance review for three years listing a position title that is not recognized in the company as a legitimate position. This was a position title no one else in the entire company had. I was rewarded evil for the good, honest service I provided during my employment.
The Coca-Cola Company allowed a Caucasian woman to work in The McDonalds Group (TMG) without a high school diploma or GED. They held an interview process for the position. She was hired, but the background check confirmed she did not graduate from high school. They allowed her to work in our department until she obtained her GED, and then they announced she had been hired for the position.
I worked eleven years before I received one promotion. Documents show The Coca-Cola Company hired a Caucasian woman without a GED, and promoted her within six months. This is why I filed a discrimination lawsuit against The Coca-Cola Company.
After three settlement offers from The Coca-Cola Company, and bad attorney advise summary judgment was awarded to The Coca-Cola Company. I was told, in a discrimination lawsuit there has to be a comparison, and there was no one in the company to compare me with. My discrimination case was not appealed even though I do have evidence to prove all my allegations. The Coca-Cola Company also submitted an affidavit that contained false testimony. Judge Richard W. Story allowed The Coca-Cola Company to do all the things listed above, to me without punishment. The Judge's final order was signed on February 9, 2005.
Five days later, I was mailed my first employment termination letter, while still disabled, and under a doctor’s care. The Coca-Cola Company would not respond to any of my complaints of unfair treatment, and intentionally did not reinstate my employment and medical insurance according to company policy after numerous requests. Therefore, I was forced to file a retaliation lawsuit. HUMAN RESOURCES IS SELF RESOURCES! THINK IT CAN'T HAPPEN TO YOU?
